David is Co-Managing Partner of the firm and Chair of the Health Care and Creditors’ Rights practice groups. A highly accomplished litigator and trial attorney, he represents commercial lenders, health care providers, nonprofits, and business clients on restructuring, governance, risk management, and complex litigation matters. Whether advocating in state or federal court or resolving disputes through arbitration, David brings sound judgment, careful preparation, and a strategic approach to every matter. He works closely with clients to understand their objectives, assess risks and opportunities, and develop practical strategies that advance their legal and business goals.
A Fellow of the American Bar Foundation, David has earned the respect of clients and colleagues alike for his thoughtful approach, clear communication, and unwavering commitment to client service. He is a recipient of the Justice Ruth Bader Ginsburg Vanguard Award from the New York State Bar Association Trial Lawyers Section, recognizing his leadership and contributions to the legal profession.
David’s legal career includes experience at the U.S. Department of Justice and the U.S. Department of State, where he interned while attending law school. He also served as Managing Editor of the Syracuse Law Review. After gaining experience at White & Case LLP in New York City, David returned to Underberg & Kessler, where he had previously distinguished himself as a summer associate, beginning a career with the firm that has spanned more than two decades.
