David brings to Underberg & Kessler broad experience in complex civil litigation matters and a deep insight into the court system. Since 2003, he has successfully defended health care providers and, prior to that, he prosecuted felony and misdemeanor cases as a Monroe County Assistant District Attorney. Dave's ability to think quickly, reason sharply, argue motions effectively, and persuasively try cases in front of a jury demonstrates his grace under pressure and serves our clients well.
Dave has held clerkships with the United States District Court for the Western District of New York and the New York State Attorney Grievance Committee of the Seventh Judicial District. He is licensed to practice before all New York State courts as well as the United States District Court for the Western District of New York. He is a graduate of Virginia Polytechnic Institute and the University of Buffalo Law School. Dave is involved in the community as a member of the Advisory Board of Directors for the National Center for Missing & Exploited Children.
Dave comes to Underberg & Kessler from The Somerset Firm, LLC with an impressive repertoire of litigation, negotiation and prosecutorial skills, enabling him to be a versatile and effective advocate for our clients.
